General Terms and Conditions (GTC)

§ 1 Scope


(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers via our online shop.


(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

§ 3 Conclusion of the Contract


(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.


(2) By clicking the ‘Buy now’, ‘Place order’ or any similarly labelled order button, you are making a binding offer to conclude a contract of sale for the goods contained in your shopping basket.


(3) Upon receipt of your order, you will automatically receive confirmation of receipt of your order by email. This order confirmation does not yet constitute acceptance of your offer.


(4) The contract of sale is only concluded upon dispatch of the goods or by means of an express order confirmation.


§ 4 Contract language and contract text


(1) The contract language is German.


(2) The text of the contract is stored. The order details and these Terms and Conditions will be sent to you by email once the order has been completed.


§ 5 Prices and Terms of Payment


(1) All prices quoted are final prices, excluding any delivery charges. In accordance with the small business scheme under Section 19 of the German Value Added Tax Act (UStG), no value added tax is charged and is therefore not shown.


(2) In addition to the prices quoted, delivery charges may apply. These will be clearly displayed before the order is finalised.


(3) The available payment methods are displayed during the ordering process. Payment is processed via the selected payment service providers.


§ 6 Delivery


(1) Delivery is made exclusively to the delivery address specified by the customer.


(2) Collection in person is not possible.


(3) Our products are manufactured using a print-on-demand process following receipt of your order. Production and dispatch are handled via our international production and logistics network. Depending on the country of delivery, manufacturing and dispatch may take place from different production sites. The estimated delivery times are specified in the online shop.


(4) Delays in delivery due to force majeure, official measures, customs clearance or unforeseeable events affecting delivery service providers do not give rise to any claim for compensation, provided that we are not responsible for such delays.


(5) For deliveries outside the European Union, customs duties, import charges or other government fees may apply. These are to be borne by the customer.


(6) Partial deliveries are permitted provided they are reasonable for the customer. If several products are ordered, these may be delivered in separate consignments due to different production sites.


§ 7 Retention of title


The goods delivered remain our property until full payment has been made.


§ 8 Right of withdrawal


Consumers are entitled to the statutory right of withdrawal.


Further details are set out in the separate cancellation policy, which forms an integral part of our online offer.


§ 9 Warranty


(1) The statutory warranty rights apply.


(2) Should an item be damaged, faulty or incorrect, please contact us as soon as possible at goetzldesigns@gmail.com so that we can deal with your enquiry promptly.


§ 10 Liability


(1) We accept unlimited liability for damage resulting from injury to life, limb or health, as well as for damage caused by wilful misconduct or gross negligence.


(2) In the event of a breach of essential contractual obligations due to slight negligence, our liability is limited to the foreseeable damage typical for this type of contract.


(3) In all other respects, liability is excluded to the extent permitted by law.


§ 11 Governing Law


(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.


(2) If you are a consumer and are habitually resident in another country, the mandatory consumer protection provisions of your country of residence shall remain unaffected by the above choice of law.


§ 12 Online Dispute Resolution


The European Commission provides a platform for online dispute resolution (ODR).

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
